Terms of Service
These are the terms you agree to by using Earshot. They are short because the product is small and the relationship is simple: you keep your data, we run the parts that need running, and either of us can walk away.
Recording is your responsibility
This is the one term that matters more than the rest of the page combined, so it is first.
You also agree not to use Earshot to record anyone in circumstances where you know or suspect they would object, and not to use it in a way that violates anyone's rights.
Your account
You need an account to sync anything, and you are responsible for what happens under it. Do not share your sign-in. Tell us at hello@earshotcrm.com if you think somebody else has it. Do not connect a mailbox you are not entitled to read.
You must be at least 16, and if you are using Earshot for an employer you must be authorised to agree to these terms on their behalf.
Your data stays yours
Everything you put into Earshot, and everything Earshot derives from it — transcripts, summaries, profiles — belongs to you. We claim no ownership of it and no licence to it beyond what is needed to run the features you are using, which is described in the Privacy Policy. We do not sell it, share it between accounts, or train models on it.
You can export all of it or delete all of it from inside the app, at any time, without asking us. Recordings live on your own machine and are never uploaded, so those were never in our hands to begin with.
What Earshot writes is a draft, not a fact
Transcripts, summaries, participant lists and profiles are produced by machine-learning models reading your mail and your meetings. They are wrong sometimes, and they are wrong in ways that read as confident. Earshot marks its guesses as guesses and lets you correct any of them, but the correction is yours to make.
Do not rely on Earshot's output as a record of what was said or agreed, as legal or financial advice, or as evidence. Check anything that matters against the recording.
Fair use
Transcription and profile building cost real money per request, so each account has a monthly ceiling on how much audio it can transcribe and how much model time it can use. The ceiling is set far above ordinary use — reaching it means something has gone wrong or the app is being used as something other than an app. If you hit it, the affected feature pauses until the next month and everything else keeps working. You can see where you stand in Settings.
You agree not to attempt to get around it, to resell access to Earshot's API, to use Earshot to build a competing dataset, or to probe, scrape or attack the service.
Availability, and what we do not promise
Earshot is provided as it is. We do not promise it will be available at any particular time, that it will not lose a sync, or that it will suit any particular purpose. Third-party services it depends on — Google, our hosting, the model providers — can and do fail, and when they do, Earshot fails with them.
To the fullest extent the law allows, we are not liable for indirect or consequential losses, for lost profits or business, or for lost data. Where liability cannot be excluded, it is limited to what you have paid us in the previous twelve months. Nothing here limits liability for death, personal injury, or fraud.
Price
Earshot is free to use today. If paid plans arrive, existing accounts will be told before anything they already have starts costing money, and nothing will be charged without an explicit agreement to pay it.
Ending it
You can stop at any time by deleting your account in Settings, which destroys everything on it immediately. We may suspend or close an account that is being used to break these terms, to harm somebody, or to attack the service — and where it is reasonable to do so, we will say why first and give you a chance to export your data.
Changes
These terms may change. If a change materially affects your rights, the app will say so before it applies to you. Continuing to use Earshot after that is how you accept it; if you would rather not, delete your account and take your export with you.
Law
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules, and the courts there have exclusive jurisdiction. If you are a consumer, this does not deprive you of the protections of the mandatory law of the country you live in.
